Karen Thorburn Photography provides access to the Karen Thorburn Photography website, www.karenthorburn.com, and sells selected products to you subject to the terms and conditions set out below. Please read these terms and conditions carefully. By using the Karen Thorburn Photography website, you signify your agreement to these terms and conditions.

Karen Thorburn Photography reserves the right to refuse access to the online purchasing facilities offered on its website, edit or remove products, or cancel orders at its discretion. Any cancelled orders will not incur any cost to you.

You understand that you, and not Karen Thorburn Photography, are responsible for all electronic communications and information sent from your computer to Karen Thorburn Photography and you must use the website for lawful purposes only.

You must not use the website in any way that may be deemed fraudulent or be unlawful in any other way.

Karen Thorburn Photography’s Contract With You

When you place an order to make a purchase from Karen Thorburn Photography, it will send you an e-mail acknowledging confirmation of your order. Any products not confirmed in an Order Confirmation E-mail do not form part of that contract.

Privacy Policy

Customer Details / Your Personal Information

Karen Thorburn Photography collects your personal information in order to deliver the products and services you want, administer its business, provide customer service and be able to communicate special offers unless you have chosen not to receive such offers.

All online transactions are made by Paypal and Karen Thorburn Photography has no access to your financial information.

Returns Policy

Karen Thorburn Photography’s returns policy does not affect your statutory rights.

Items returned within the seven working day cooling-off period

By law, customers located in the European Union have the right to withdraw from the purchase of an item within seven working days of the day the item is delivered.

Where you are withdrawing from your purchase within the seven working day cooling-off period, and there has been no error on the part of Karen Thorburn Photography, it will refund the cost of the item and the cost of delivering the item to you.

Please contact Karen Thorburn Photography within seven working days of the day the item was delivered, stating your name and address, the order number, and the item(s) you wish to return. Please do not return any item(s) to Karen Thorburn Photography before contacting its office.

Karen Thorburn Photography will not refund your costs in returning the item to Karen Thorburn Photography unless you are returning the item because of an error on the part of Karen Thorburn Photography. Any item returned must be packed in its original packaging.

Please be aware that you will be responsible for returning the item to Karen Thorburn Photography unless it delivered the item to you in error, or if the item is damaged. To ensure safe return of the item to Karen Thorburn Photography, it may, at your request, arrange for collection from your address at your cost. In this instance, once Karen Thorburn Photography’s courier has collected the item, Karen Thorburn Photography will assume the responsibility for its safe return to Karen Thorburn Photography and therefore this method of return is recommended. When you contact Karen Thorburn Photography to inform it of your wish to return the item, it will provide a quotation for the collection and, where appropriate, take payment by credit or debit card via bank transfer or Paypal.

If you wish to use your own method of return, this must be agreed with Karen Thorburn Photography before you proceed.

On receipt of your item at Karen Thorburn Photography’s office, subject to it fulfilling the criteria stated above, Karen Thorburn Photography will refund the item and delivery charge to your bank or Paypal account.

Items returned because they are incorrect or damaged

If you are returning an item because of an error on the part of Karen Thorburn Photography or because the item is damaged, Karen Thorburn Photography will arrange for the collection of the incorrect or damaged item and organise for a replacement to be sent to you at Karen Thorburn Photography’s cost.

Please contact Karen Thorburn Photography’s office by e-mail within seven working days of the day the item was delivered stating your name and address, the order number, the item(s) you wish to return, and whether the item(s) was/were sent in error or has/have been damaged in transit. Please do not return any items to Karen Thorburn Photography at your own expense. Karen Thorburn Photography will arrange with you a convenient day to collect the incorrect/damaged item(s). Any item(s) returned must be packed in its/their original packaging.

The delivery of the correct item or replacement for a damaged item will be dispatched to you as soon as possible and will be arranged with you by e-mail.

Pricing and Availability

All items are printed to order. Please allow up to fourteen working days for delivery from the date your order was confirmed. You will be kept advised of the process of your order but you may contact Karen Thorburn Photography at any time for a status update.

Errors and Omissions Excepted (E & OE)

Despite the efforts of Karen Thorburn Photography, it is possible that occasionally products on its website may be mis-priced. All prices are verified when your order is confirmed. If a product’s correct price is lower than the stated price, Karen Thorburn Photography will charge you the lower amount. If a product’s correct price is higher than the stated price, Karen Thorburn Photography will, at its discretion, confirm your order at the lower price, contact you for instructions before confirming your order, or cancel your order and notify you of the cancellation.

Events Beyond Karen Thorburn Photography’s Reasonable Control

Karen Thorburn Photography will not be held responsible for any delay or failure to comply with its obligations under these terms and conditions if the delay or failure arises from any cause which is beyond the reasonable control of Karen Thorburn Photography. This condition does not affect your statutory rights.

Alterations and Amendments

Karen Thorburn Photography reserves the right to make changes to its website, policies and these terms and conditions at any time. If for any reason any of these conditions is deemed unenforceable, that condition will be deemed severable and will not affect the validity of any remaining conditions.

Law

All contracts between you (the buyer) and Karen Thorburn Photography (the seller) shall be governed by the laws of Scotland. You agree, as does Karen Thorburn Photography, to submit to the jurisdiction of the courts of Scotland.
